This article answers the most frequently asked questions about NIS2 in the Netherlands.<\/p>\n<h2>Is the NIS2 directive already in effect in the Netherlands?<\/h2>\n<p>The NIS2 directive has been in force at the European level since January 2023, but the Netherlands has not yet fully transposed it into national law. The deadline for member states was October 17, 2024. The Netherlands missed that deadline and is working on the Cybersecurity Act as its implementing legislation. In 2026, this legislative process is at an advanced stage, but the law has not yet been formally adopted.<\/p>\n<p>That does not mean organizations can afford to wait. The European directive itself already clearly outlines which obligations apply, and regulators are preparing for enforcement as soon as the law comes into force. Organizations that begin preparing now will avoid a last-minute scramble once the Cybersecurity Act is eventually adopted. Moreover, business partners and clients increasingly expect demonstrable <a href=\"https:\/\/www.netwayseurope.com\/en\/solutions\/security\/\">security practices<\/a>, regardless of the formal legal status.<\/p>\n<h2>Which organizations fall under NIS2 legislation?<\/h2>\n<p>NIS2 applies to medium-sized and large organizations in sectors designated as essential or important. Specifically, this covers organizations with more than 50 employees or an annual turnover exceeding 10 million euros, operating in designated sectors. Small businesses are generally outside the scope, unless they play a critical role in a vital supply chain.<\/p>\n<h3>Essential sectors<\/h3>\n<p>Organizations in the following sectors fall under the strictest category of NIS2 and are designated as essential entities:<\/p>\n<ul>\n<li>Energy (electricity, gas, oil)<\/li>\n<li>Transport (aviation, rail, road, maritime)<\/li>\n<li>Healthcare (hospitals, laboratories, pharmaceutical industry)<\/li>\n<li>Drinking water and wastewater<\/li>\n<li>Digital infrastructure (data centers, cloud services, internet exchange points)<\/li>\n<li>Financial sector (banks, financial market infrastructure)<\/li>\n<\/ul>\n<h3>Important sectors<\/h3>\n<p>In addition to essential entities, NIS2 also defines a category of important entities. The core principle is that your organization must demonstrably have control over its digital risks and must report incidents promptly to the competent supervisory authority.<\/p>\n<p>The key obligations for <a href=\"https:\/\/www.netwayseurope.com\/en\/solutions\/networking\/\">network security<\/a> are:<\/p>\n<ul>\n<li><strong>Risk analysis and security policy:<\/strong> You document the risks your network faces and the measures you take to manage them.<\/li>\n<li><strong>Supply chain security:<\/strong> You also assess the security practices of suppliers and partners who have access to your systems.<\/li>\n<li><strong>Access management and authentication:<\/strong> Strong authentication and strict access controls are mandatory for critical systems.<\/li>\n<li><strong>Encryption:<\/strong> Sensitive data must be encrypted both in transit and at rest. Real-time monitoring of fiber optic connections is an example of a measure that contributes to demonstrable control over the physical network layer.<\/p>\n<h2>What are the penalties for non-compliance with NIS2?<\/h2>\n<p>NIS2 introduces substantial sanctions for organizations that fail to meet their obligations. Essential entities risk fines of up to 10 million euros or 2% of global annual turnover, whichever is higher. For important entities, the maximum fine is 7 million euros or 1.4% of global annual turnover.<\/p>\n<p>In addition to financial penalties, NIS2 also introduces personal liability for executives. In serious cases, regulators can impose a temporary ban on senior management if an organization persistently falls short. This makes NIS2 fundamentally different from previous cybersecurity regulations, where responsibility was rarely placed so directly on management.<\/p>\n<p>It is important to understand that enforcement is not about checking boxes on a list. Regulators look at the maturity of your security approach, the quality of your risk analysis, and how you handle incidents. An organization that demonstrably takes security seriously but fails to report an incident in time faces a different risk than one that consistently takes no measures at all.<\/p>\n<h2>How do you prepare an organization for NIS2 compliance?<\/h2>\n<p>Effective preparation for NIS2 compliance starts with insight: do you know which systems and processes are critical, what risks are present, and what measures are already in place?
